Using Nuvi means agreeing to what's below. It's organized so you can jump to the part you care about — the index links to every section.
1. Acceptance of these terms
By creating a Nuvi account, subscribing, or using the app in any way, you agree to these terms. If you don't agree, don't use Nuvi.
These terms are between you and [Nuvi entity — TODO(legal)] — "we," "us," or "Nuvi" below. They cover the Nuvi app, nuviapp.org, and anything served from either.
2. Eligibility
You need to be at least 16 to use Nuvi. Where the law that applies to you sets a higher age for agreeing to terms like these, that age governs instead.
If you're under 18, you need a parent or guardian's permission to buy a subscription — the App Store already asks for this before a minor's account can pay for anything.
Using Nuvi means confirming the above is true of you.
3. What Nuvi does
You point the camera at a product — a barcode or a label — and Nuvi reads it against the goal you set (lose fat, build muscle, or maintain) and answers yes or no. That's the whole product: one question, one answer.
A verdict is Nuvi's reading of a label against your goal, not a certified analysis. A label can be photographed at an angle, ingredients change between batches, and a reading can be wrong. Section 9 covers what a verdict is not.
We can add, change, or remove a feature at any time — section 11 covers what that means for you.
4. Your account and Sign in with Apple
Nuvi uses Sign in with Apple. There's no separate password to set or lose — your Apple ID is how you get in.
You're responsible for what happens through your account. Keep your device and your Apple ID secure; anything done from your account is treated as done by you.
Write to [email protected] if you think someone else has access to your account.
5. Subscriptions, free trial, and billing
Nuvi gives you a number of free scans, then asks for a subscription for unlimited use. Every plan shows its price, its billing period, and — when it has one — the length of its free trial, before you pay, in your own currency.
In the app, the purchase goes through the App Store and Apple bills you. A free trial converts automatically into the paid subscription unless you cancel before it ends — there's no separate reminder from us. Manage or cancel anytime from Settings → your name → Subscriptions on your iPhone; cancelling stops the next renewal but doesn't refund the period you've already paid for.
Refunds for an App Store purchase follow Apple's own refund policy and go through Apple, at reportaproblem.apple.com or Settings → your name → App Store. We can't issue that refund ourselves.
On the web, Stripe processes the payment as the merchant of record — the seller named on your receipt — and you cancel from the confirmation email or by writing to [email protected]. Refunds there follow Stripe's policy for the seller, the same as for any Stripe purchase.
A price can change. A change never applies to a period you've already paid for — it applies from your next renewal, and we'll show it before you're charged.
6. Your content and photos submitted to the catalog
When a photo you take is sharp, framed on the product, and free of any face or other identifying detail, Nuvi may offer to add it to the public catalog other people see when they scan the same product. Submitting a photo is your consent to that use — nothing gets added without you choosing to submit it.
You keep ownership of a photo you submit. You grant Nuvi a non-exclusive, worldwide, royalty-free license to host, display, and use it inside the catalog for as long as it stays there.
Ask to have a photo withdrawn from the catalog anytime at [email protected]. We'll remove it; a copy already served to someone else's device before the removal may still sit in that device's cache for a while.
Only submit a photo of a product you actually have in front of you, with nobody else's face in frame. Submitting a photo you don't have the right to share is a breach of these terms.
7. Acceptable use
Use Nuvi to scan real products and read real verdicts. Don't:
reverse-engineer, decompile, or scrape the app or its data
interfere with App Attest, or otherwise present a request as coming from a device it didn't come from
resell, redistribute, or bulk-export verdicts or catalog data
upload a photo you don't have the right to share, or one with an identifiable person in it
use Nuvi in a way that breaks a law that applies to you
We can suspend or close an account that does any of this — section 12 covers how.
8. Intellectual property
Nuvi, the Nuvi name and mark, the app, and everything in it besides the content you submit — the design, the verdict logic, the catalog as a whole — belong to [Nuvi entity — TODO(legal)] or its licensors.
Using Nuvi gives you a personal, non-exclusive, non-transferable license to run the app on your own device, for as long as your account is active. Nothing here transfers ownership of anything to you.
9. Medical disclaimer
Nuvi is not medical advice, not nutrition advice from a licensed professional, and not a diagnosis. A verdict says whether a product fits the goal you set — nothing more.
Talk to a doctor or a registered dietitian before you use Nuvi to manage a medical condition, a food allergy, or a diet a professional has prescribed for you. Nuvi doesn't know your medical history and can't account for it.
Nuvi is not built or intended to treat an eating disorder, and it isn't a substitute for the care one requires. If food or your weight feels like it's controlling you rather than the other way around, talk to a professional — in the US, the National Eating Disorders Association (nationaleatingdisorders.org) is a place to start; most countries have an equivalent.
10. Privacy
The Privacy Policy explains what we collect to run Nuvi, why, and who we share it with. It's linked at the bottom of this page and everywhere in the app that asks you for anything.
11. Service availability and changes
We aim to keep Nuvi available, but we don't promise it will always be — a scan model can be down, a store can review-reject an update, a server can go offline. Section 14 covers what we're liable for when that happens.
We can add, remove, or change a feature, a plan, or a price at any time. A change to what a paid plan includes gets notice inside the app before it takes effect for anyone already subscribed.
12. Termination
Delete your account anytime from the app — Account → Delete account — or by writing to [email protected]. Deleting it stops any active subscription from renewing, but doesn't refund what's already been billed.
We can suspend or close an account that breaks these terms, abuses the product, or puts other people's data or the service itself at risk. Where we reasonably can, we'll tell you why.
Sections 6 (the license you granted for a photo you submitted, until you ask us to remove it), 8, 9, 13, 14, 15, and 16 survive your account closing.
13. Disclaimer of warranties
NUVI IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE EXTENT THE LAW WHERE YOU LIVE ALLOWS IT, WE DISCLAIM EVERY WARRANTY, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DON'T WARRANT THAT A VERDICT IS ACCURATE, THAT NUVI WILL RUN UNINTERRUPTED, OR THAT IT WILL MEET YOUR EXPECTATIONS.
Where the law that applies to you doesn't allow one of these disclaimers, it doesn't apply to you — the rest of this section still does.
14. Limitation of liability
TO THE EXTENT THE LAW WHERE YOU LIVE ALLOWS IT, [NUVI ENTITY — TODO(LEGAL)] IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGE, OR FOR ANY LOSS OF DATA, USE, OR PROFIT, ARISING FROM YOUR USE OF NUVI — INCLUDING A DECISION YOU MAKE BASED ON A VERDICT.
TO THE EXTENT THE LAW ALLOWS IT, OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO NUVI IS LIMITED TO WHAT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR 50 USD IF YOU HAVEN'T PAID US ANYTHING.
Nothing here limits a liability that the law where you live doesn't let us limit — for example, liability for death or personal injury caused by negligence, or for fraud.
15. Indemnification
You agree to cover [Nuvi entity — TODO(legal)] for a claim, loss, or expense — including a reasonable legal fee — that comes from your breaking these terms, misusing Nuvi, or submitting content you didn't have the right to share.
16. Governing law and dispute resolution
These terms are governed by the law of Spain, where [Nuvi entity — TODO(legal)] is domiciled, without taking away any protection the mandatory consumer law of your own country of residence gives you.
If something goes wrong, write to [email protected] first — most things get resolved there faster than in a courtroom. A dispute that doesn't gets decided by the courts of [city, Spain — TODO(legal)], unless the mandatory law of your country of residence gives you the right to bring it somewhere else.
17. Changes to these terms
We can update these terms. We'll move the date at the top when we do, and if a change meaningfully reduces your rights or changes what a paid plan includes, we'll tell you inside the app before it takes effect. Using Nuvi after a change takes effect means you accept it.
